Terms and Conditions

Tours are managed and/or operated in full or part thereof by Massive Adventures (Pty) Ltd, herein after referred to as “MASSIVE”.

RELEASE OF LIABILITY AND ASSUMPTIONS OF ALL RISKS
Any person(s) who fail to provide a signed “Release of Liability and Assumption of All Risks” and personal information forms prior to trip departure will not be allowed to join the trip and the cancellation policy applies. Any damages/injuries incurred that are attributable to your own actions, acts of some other party unconnected with the contract services or where the damage/injury results from events/circumstances which are our outside our control and could not be reasonably foreseen. For damages where MASSIVE is responsible, our liability is strictly limited to twice the total price of the tour. In booking a tour with MASSIVE you, the client, are agreeing to these terms and you accept this limit on our liability. This limit allows us to keep the prices of our tours as low as possible. Any claims must be made in writing to MASSIVE within one month after the end date of the tour. Any claims made after one month of the end date of the tour may not be considered. Compensation claims may be limited or excluded in full or part thereof, if international agreements or legal norms, which can be applied to performances of an agent or supplier, provide for a limitation or exclusion of compensation claims against this supplier under certain circumstances.

TERMS OF PAYMENT
Payment of your deposit or the full tour price, equates to agreeing to the Booking and Services and stipulations as indicated below. All bookings are subject to available space on the relevant tour. All bookings made more than 60 days in advance require a 50% deposit payable per person. The balance payment for bookings made more than 60 days in advance must be settled in full 60 days prior to departure. Bookings made less than 60 days in advance will require full payment to secure your spot on the tour. No person(s) will be allowed to join a tour without fully settling their invoice.

CANCELLATION OF A BOOKING BY THE CUSTOMER
The client may cancel the booking at any time, but the cancellation fees, as set out below, will apply to all cancellations. We will require notification of cancellation in writing from the person who made the booking. Cancellation will take place upon receipt of written confirmation by the person who made the booking. Exceptions to this policy cannot be made for any reason, including weather or personal emergencies. There is no refund for arriving late or leaving a trip early. Single supplements are considered part of the trip price and are subject to cancellation fees.

CANCELLATION OF TOURS OR CHANGES MADE TO TOURS BY MASSIVE
MASSIVE reserves the right to change a tour if necessary due to but not limited to unforeseen circumstances like adverse weather, accommodation changes and route changes. MASSIVE reserves the right to cancel a tour in the event of minimum numbers not reached for the specific tour and MASSIVE will refund in full any monies paid by the customer in the event of a cancellation due to minimum numbers for the relevant tour not reached. MASSIVE reserves the right to change or cancel in full or part thereof a tour in the event of but not limited to force majeure such as war, threat of war, riot, civil strife, industrial dispute, terrorist activity, natural or nuclear disaster, adverse weather conditions or other circumstances unforeseeable at the moment of conclusion of the booking. MASSIVE reserves the right to claim an appropriate compensation for any costs incurred and activities performed so far.

ITINERARY ALTERATIONS
It is your understanding and you accept at the time of booking the tour that the itinerary is an outline and may change to accommodate local circumstances. These include, but are not limited to; unpredictable and/or severe weather conditions, natural disaster, civil strife, industrial disputes and other disruptions, which may need to be accommodated for. You agree to be flexible and agree change arrangements where necessary. No refunds will be given for unused services or the costs of provision of services not used for reasons in whole or in part the fault of the customer. MASSIVE will not produce invoices concerning single elements of the tour.

MEDIA, SOCIAL MEDIA, PHOTOS AND VIDEOS
Any person taking part in a tour operated in part or in full by MASSIVE grants MASSIVE express permission to take photographs or make film records of its trips for promotional and/or commercial use, as well as approve such use by third parties with whom MASSIVE may engage in joint marketing, without financial remuneration. You also acknowledge and grant permission to MASSIVE to use any such material on social media platforms. All media material (incl. photos, video etc.) remains the property of MASSIVE.

AUTHORITY OF TOUR GUIDE
Signing up for a tour and agreeing to the terms and conditions when making the booking, means that while on the tour you agree and will abide to the authority of the tour guide who represents MASSIVE, at all times. If, in the experience and opinion of the tour guide, your health or behavior on the tour is deemed to be detrimental to the health and/or safety, comfort or enjoyment of yourself or others, you may be excluded from part of or the entire trip. If you are excluded from the trip for any of these reasons, MASSIVE shall cease to have any responsibility for you and no refund will be made. At all times the authority of your tour guide will be final when concerning matters likely to endanger your own health or safety or in regard to behavior or ill health that is causing or is likely to cause danger, distress or disturbance to the group and the well-being of the tour. Failure to abide by the authority of the tour guide could result in legal proceedings and the immediate termination of your participation in the tour without recourse. In such circumstances MASSIVE reserve the right to terminate all travel arrangements without liability on the part of the company. You must always comply with the local law, customs and drug regulations of the country you are visiting. Failure to do so may lead to you being ordered to leave the tour without recourse to any refund or any legal claim against the company. The person who books and agree to the booking conditions whilst making the booking (which incorporates these conditions) warrants that he/she does so, with full authority on behalf of all those whose names appear thereon, and confirms thereby that all such persons accept and are fully aware of these conditions.

FLIGHTS/DELAYS AND JOINING THE GROUP LOCALLY
Our tour prices do not include flights but does include transfers to and from Johannesburg International airport or any other airport as specified in the tour itinerary. Any flights (both international and/or domestic) forming part of your holiday will be subject to the General Conditions of Carriage and Conditions of Contract of the airline and will be booked and/or paid by you. MASSIVES’s responsibility does not commence until the first day of the scheduled tour and notified date and time. If you fail to arrive there at the notified date and time, MASSIVE shall not be responsible for any additional expenses incurred by you in meeting up with the group due to flight or any other delays.

INSURANCE
MASSIVE highly recommends that you have adequate travel or medical insurance for the duration of your tour. MASSIVE recommends that, as a minimum (but not limited to), your insurance should include at least personal injury, medical expenses, death, repatriation, and loss of luggage or equipment, helicopter or aircraft rescue, cancellation or curtailments. It is also your responsibility to ensure that there are no exclusion clauses limiting protection or cover for the type of activities included in your tour. Any claims concerning matters for which you are insured must be directed to your insurers. MASSIVE will ask you to complete an insurance waiver form should you decide to take part in a tour without any travel or medical insurance. MASSIVE will also ask for a copy of your valid travel or medical insurance before the start of the tour. Please note – there are inherent risks involved in cycling, cycle touring and mountain biking. MASSIVE will not be held liable for any medical or other expenses or evacuation in case of an accident. Information provided by MASSIVE about these matters and other related items (including, but not limited to clothing, baggage, climate etc.) are given in good faith but without responsibility on the part of MASSIVE.

HEALTH
Any person taking part in one of the tours must be relatively fit to take part. Any client with a pre-existing medical condition or illness must declare such conditions when booking or before the start of the tour. MASSIVE may require a medical statement from a GP confirming that the person(s) are fit and healthy to take part in the tour. MASSIVE reserves the right to refuse a participant who is deemed medically unfit to take part. Participants must also inform MASSIVE if there is any change in medical conditions between booking and the starting date of the tour.

PASSPORTS, VISAS AND VACCINATIONS
It is your responsibility to be in possession of a valid passport, visa permits and have up to date inoculations and any preventative medicines as may be required, for the duration of your tour. MASSIVE will not refund, either in part or full, any cost of the tour or any fees and/or expenses relating to the booked tour, if the person who is supposed to take part in the tour cannot because of invalid travel documents and visas. It is your responsibility to check with your relevant embassy and the local South African consulate regarding current visa and passport rules. It is also your responsibility to speak with your local doctor or health care professional to get correct up to date medical advice regarding inoculations, anti-malarial medication or any other preventative medicine.

PARTICIPATION AND RESPONSIBILITIES
Any person(s) joining or taking part in a tour either in part or in full do so willingly and at their own risk. Any person(s) taking part agree to indemnify MASSIVE against claims for loss or damage to personal property, personal injury (or death) and any claim arising from the person(s) own actions. MASSIVE shall not be liable for the theft of your bicycle (whether hired or not) or any equipment or personal belongings whilst on a tour. MASSIVE shall not be liable for injury as a result of cycling, either on a public road, private road or off the road and, in particular, injuries as a result of inadequately serviced or maintained cycling equipment. Any person(s) taking part either in full or part thereof are aware that there are inherent risks involved in cycling, cycle touring and mountain biking and that tours will be done on both public and private roads. It is the person(s) responsibility to obey all local laws, rules and regulations at all times. Any person(s) taking part in a tour agrees to where a safety helmet at all times whilst riding a bicycle, regardless of riding on a public road, private road or off the road. Failure to do this could result in the tour guide refusing for the person(s) to take part in the tour and asking them to leave the tour.

COMPLAINTS
Should you have a complaint while on tour, you must notify your guide or MASSIVE immediately, so that they can do what they can to rectify it as soon as possible. If the complaint is not brought to our attention, then we have no opportunity to rectify it. If you are not satisfied with the response or resolution, you must write to MASSIVE not more than 21 days after the tour ends.
